1. INLEDNING
Dessa allmänna villkor (”Villkor”) reglerar din tillgång till och användning av mobilapplikationen Winsty och tillhörande tjänster (”Tjänsten”), som drivs av Winsty AB, org.nr 559386-5776 (”Winsty”, ”vi”, ”oss” eller ”vår”).
Genom att skapa ett konto, ladda ner appen eller använda vår Tjänst godkänner du att vara bunden av dessa Villkor. Om du inte godkänner dessa Villkor får du inte använda Tjänsten.
2. BEHÖRIGHET OCH KONTO
2.1 Behörighet
För att använda Tjänsten måste du:
Vara minst 15 år gammal eller ha vårdnadshavares godkännande.
Ha rätt att ingå avtal.
Inte vara förbjuden enligt lag att använda Tjänsten.
Inte tidigare ha blivit avstängd från Tjänsten av oss.
2.2 Kontoansvar
Du samtycker till att:
Lämna korrekt, aktuell och fullständig information om dig själv.
Upprätthålla säkerheten för dina inloggningsuppgifter.
Inte dela ditt konto eller dina inloggningsuppgifter med andra.
2.3 Otillåtet beteende
Du får inte:
Utge dig för att vara någon annan.
Lämna falska eller vilseledande uppgifter.
Trakassera, mobba, kränka, hota eller skada andra användare.
Använda Tjänsten för olagliga ändamål eller vilseledande, påträngande eller oönskad marknadsföring.
Missbruka Tjänsten för spam, bedrägerier eller trakasserier.
Med “oönskad marknadsföring” avses exempelvis massutskick av reklam, spam, försäljningsförsök eller påträngande annonsering som mottagaren inte har bett om.
2.4 Klubbkonton och representation
Om du skapar eller administrerar ett konto för en klubb, förening eller annan organisation intygar du att du har rätt att företräda organisationen och att publicera information för dess räkning.
Du ansvarar för att information som publiceras om klubben, laget eller organisationen är korrekt och att du har nödvändiga rättigheter och tillstånd för innehåll som du publicerar.
3. TJÄNSTEN OCH ANSVARSFRISKRIVNING
3.1 Tjänstens funktion
Winsty är en digital plattform för sportrelaterade profiler, klubbar, möjligheter och kommunikation mellan användare.
Information som visas i Tjänsten kan baseras på både användargenererat innehåll och offentligt tillgängliga sportuppgifter. Vi kan inte garantera att all information är fullständig, korrekt eller uppdaterad.
Du ansvarar själv för att granska och uppdatera dina uppgifter i appen.
3.2 Kommunikation och innehåll
Winsty ansvarar inte för innehåll, åsikter eller uttalanden som delas mellan användare i chattar, profiler eller inlägg.
3.3 Tillgänglighet och förändringar i Tjänsten
Vi strävar efter att Tjänsten ska vara tillgänglig och fungera på ett tillförlitligt sätt, men garanterar inte att Tjänsten alltid är tillgänglig, oavbruten eller fri från fel.
Vi kan från tid till annan uppdatera, ändra, lägga till eller ta bort funktioner, exempelvis för att förbättra Tjänsten, åtgärda tekniska problem eller av säkerhetsskäl.
3.4 Möjligheter och kontakter mellan användare
Winsty tillhandahåller verktyg som gör det möjligt för användare, spelare, klubbar och andra aktörer att hitta och kontakta varandra. Winsty är inte part i eventuella överenskommelser som träffas mellan användare genom Tjänsten och garanterar inte att en möjlighet, ansökan, kontakt eller annan interaktion leder till ett visst resultat. Användare ansvarar själva för information de lämnar och för beslut som fattas i samband med kontakter genom Tjänsten.
3.5 Externa tjänster och partnererbjudanden
Tjänsten kan innehålla länkar, erbjudanden eller rabattkoder från tredje parter. När du lämnar Winsty och använder en tredje parts webbplats, app, produkt eller tjänst gäller den tredje partens egna villkor och integritetspolicy. Winsty ansvarar inte för tredje parts tjänster, innehåll eller behandling av personuppgifter.
4. INNEHÅLL OCH DATAANVÄNDNING
4.1 Licens
Du behåller äganderätten och andra rättigheter till innehåll som du publicerar i Tjänsten.
Genom att publicera innehåll, exempelvis bilder, texter och profilinformation, ger du Winsty en icke-exklusiv rätt att lagra, visa, behandla och tekniskt anpassa innehållet i den utsträckning som krävs för att tillhandahålla och driva Tjänsten.
Licensen upphör när innehållet eller ditt konto raderas, med undantag för innehåll som behöver sparas under en begränsad tid av tekniska, rättsliga eller säkerhetsmässiga skäl.
4.2 Ansvar
Du ansvarar själv för det innehåll du publicerar och att det inte bryter mot lag eller tredje parts rättigheter.
4.3 Rapportering
Om du stöter på innehåll som bryter mot dessa Villkor, är olämpligt, kränkande eller gör intrång i upphovsrätt, uppmanar vi dig att rapportera det till oss.

Vi förbehåller oss rätten att granska, ta bort innehåll och vidta åtgärder mot konton som bryter mot reglerna.
4.4 Winstys rättigheter
Winsty och dess programvara, design, varumärken, logotyper, grafik och annat material som tillhandahålls av Winsty skyddas av immateriella rättigheter. Användning av Tjänsten innebär inte att sådana rättigheter överlåts till användaren. Du får inte kopiera, modifiera, distribuera eller på annat sätt använda sådant material utöver vad som är nödvändigt för normal användning av Tjänsten, om inte Winsty uttryckligen har godkänt detta.
5. KOMMUNIKATION OCH CHATT
Du ansvarar själv för hur du kommunicerar med andra användare.
Winsty ansvarar inte för privata konversationer mellan användare.
Vi förbehåller oss rätten att granska och moderera innehåll vid misstanke om regelbrott.
6. SÄKERHET
Winsty genomför normalt inte identitets- eller brottsregisterkontroller av användare. Du bör därför använda eget omdöme när du kommunicerar med eller träffar andra personer genom Tjänsten. Rapportera misstänkt, olämpligt eller otillåtet beteende till [email protected].
7. UPPSÄGNING OCH AVSTÄNGNING
Du kan när som helst sluta använda Tjänsten och radera ditt konto genom de funktioner som finns tillgängliga i Tjänsten.
Vi förbehåller oss rätten att begränsa, tillfälligt stänga av eller avsluta ett konto om användaren bryter mot dessa Villkor, använder Tjänsten på ett sätt som kan skada andra användare eller Tjänsten, eller om vi har skälig anledning att misstänka bedrägeri, falsk identitet, missbruk eller annan otillåten användning.
Vid allvarliga överträdelser kan ett konto stängas av eller avslutas omedelbart.
8. ANSVARSBEGRÄNSNING
Winsty tillhandahåller en digital plattform som gör det möjligt för användare, spelare, klubbar och andra aktörer att skapa profiler, publicera information och komma i kontakt med varandra.
Winsty ansvarar inte för beslut, överenskommelser, handlingar eller andra konsekvenser som uppstår till följd av kontakter eller interaktioner mellan användare genom Tjänsten.
Winsty garanterar inte att information som tillhandahålls av andra användare eller hämtas från offentligt tillgängliga källor alltid är fullständig, korrekt eller aktuell.
I den utsträckning det är tillåtet enligt tillämplig lag ansvarar Winsty inte för indirekta skador som uppstår i samband med användningen av Tjänsten.
Ingenting i dessa Villkor begränsar eller utesluter ansvar som enligt tillämplig lag inte får begränsas eller uteslutas.

10. TVISTLÖSNING
10.1 Tillämplig lag
Svensk lag ska tillämpas.
10.2 Tvister
Om en tvist inte kan lösas genom överenskommelse kan du som konsument ha rätt att vända dig till Allmänna reklamationsnämnden (ARN) eller annan behörig alternativ tvistlösningsinstans. Tvister kan även prövas av behörig svensk domstol. Tvingande konsumentskyddslagstiftning påverkas inte av dessa Villkor.
11. ÄNDRINGAR AV VILLKOREN
Vi kan uppdatera dessa Villkor när Tjänsten förändras eller när det krävs av rättsliga, tekniska eller verksamhetsmässiga skäl. Vid väsentliga ändringar informerar vi dig på lämpligt sätt, exempelvis i Tjänsten eller via e-post, innan ändringarna börjar gälla.

1. INTRODUCTION
These General Terms and Conditions (“Terms”) govern your access to and use of the Winsty mobile application and related services (“Service”), operated by Winsty AB, reg. no. 559386-5776 (“Winsty”, “we”, “us” or “our”).
By creating an account, downloading the app or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
2. ELIGIBILITY AND ACCOUNT
2.1 Eligibility
To use the Service, you must:
Be at least 15 years old or have parental/guardian consent.
Have the right to enter into an agreement.
Not be prohibited by law from using the Service.
Not previously have been suspended from the Service by us.
2.2 Account Responsibility
You agree to:
Provide accurate, current and complete information about yourself.
Maintain the security of your login credentials.
Not share your account or your login credentials with others.
2.3 Prohibited Conduct
You may not:
Impersonate another person.
Provide false or misleading information.
Harass, bully, insult, threaten or harm other users.
Use the Service for illegal purposes or for misleading, intrusive or unsolicited marketing.
Abuse the Service for spam, fraud or harassment.
“Unsolicited marketing” refers, for example, to mass distribution of advertising, spam, sales attempts or intrusive advertising that the recipient has not requested.
2.4 Club Accounts and Representation
If you create or administer an account for a club, association or other organisation, you confirm that you have the right to represent the organisation and to publish information on its behalf.
You are responsible for ensuring that information published about the club, team or organisation is accurate and that you have the necessary rights and permissions for any content you publish.
3. THE SERVICE AND DISCLAIMER
3.1 Function of the service
Winsty is a digital platform for sports-related profiles, clubs, opportunities and communication between users.
Information displayed in the Service may be based on both user-generated content and publicly available sports data. We cannot guarantee that all information is complete, accurate or up to date.
You are responsible for reviewing and updating your information in the app.
3.2 Communication and Content
Winsty is not responsible for content, opinions or statements shared between users in chats, profiles or posts.
3.3 Availability and Changes to the Service
We aim to ensure that the Service is available and operates reliably, but we do not guarantee that the Service will always be available, uninterrupted or free from errors.
From time to time, we may update, modify, add or remove features, for example to improve the Service, resolve technical issues or for security reasons.
3.4 Opportunities and Contacts Between Users
Winsty provides tools that enable users, players, clubs and other parties to find and contact one another. Winsty is not a party to any agreements entered into between users through the Service and does not guarantee that an opportunity, application, contact or other interaction will lead to any particular outcome.
Users are responsible for the information they provide and for decisions made in connection with contacts established through the Service.
3.5 External Services and Partner Offers
The Service may contain links, offers or discount codes from third parties. When you leave Winsty and use a third party’s website, app, product or service, that third party’s own terms and privacy policy apply.
Winsty is not responsible for third-party services, content or processing of personal data.
4. CONTENT AND DATA USE
4.1 Licence
You retain ownership and other rights to content that you publish in the Service.
By publishing content, such as images, text and profile information, you grant Winsty a non-exclusive right to store, display, process and technically adapt the content to the extent necessary to provide and operate the Service.
The licence ends when the content or your account is deleted, except where content needs to be retained for a limited period for technical, legal or security reasons.
4.2 Responsibility
You are responsible for the content you publish and for ensuring that it does not violate the law or the rights of third parties.
4.3 Reporting
If you encounter content that violates these Terms, is inappropriate, offensive or infringes copyright, we encourage you to report it to us.

We reserve the right to review, remove content and take action against accounts that violate these rules.
4.4 Winsty’s Rights
Winsty and its software, design, trademarks, logos, graphics and other materials provided by Winsty are protected by intellectual property rights.
Use of the Service does not transfer any such rights to the user. You may not copy, modify, distribute or otherwise use such materials beyond what is necessary for normal use of the Service unless expressly authorised by Winsty.
5. COMMUNICATION AND CHAT
You are responsible for how you communicate with other users.
Winsty is not responsible for private conversations between users.
We reserve the right to review and moderate content in case of suspected violations of the rules.
6. SAFETY
Winsty does not normally conduct identity checks or criminal background checks on users. You should therefore exercise your own judgement when communicating with or meeting other people through the Service.
Report suspected, inappropriate or prohibited behaviour to [email protected].
7. TERMINATION AND SUSPENSION
You may stop using the Service and delete your account at any time using the functionality available within the Service.
We reserve the right to restrict, temporarily suspend or terminate an account if the user violates these Terms, uses the Service in a manner that may harm other users or the Service, or if we have reasonable grounds to suspect fraud, false identity, misuse or other unauthorised use.
In the event of serious violations, an account may be suspended or terminated immediately.
8. LIMITATION OF LIABILITY
Winsty provides a digital platform that enables users, players, clubs and other parties to create profiles, publish information and connect with one another.
Winsty is not responsible for decisions, agreements, actions or other consequences arising from contacts or interactions between users through the Service.
Winsty does not guarantee that information provided by other users or obtained from publicly available sources is always complete, accurate or up to date.
To the extent permitted by applicable law, Winsty shall not be liable for indirect damages arising in connection with the use of the Service.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law.
9. PERSONAL DATA & GDPR

10. DISPUTE RESOLUTION
10.1 Governing Law
These Terms shall be governed by and construed in accordance with Swedish law.
10.2 Disputes
If a dispute cannot be resolved by agreement, you as a consumer may have the right to refer the matter to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN) or another competent alternative dispute resolution body.
Disputes may also be brought before a competent Swedish court.
Nothing in these Terms affects any mandatory consumer protection rights available to you under applicable law.
11. CHANGES TO THESE TERMS
We may update these Terms when the Service changes or where necessary for legal, technical or operational reasons.
In the event of material changes, we will inform you in an appropriate manner, for example through the Service or by email, before the changes take effect.
